Pricing offered with the vendor’s submission shall be fixed for the initial contract term. Requests for price increases for subsequent renewal terms shall be submitted no later than ninety (90) days prior to the expiration of the prior term. Price increases for renewal terms shall be subject to a maximum negotiated increase of no more than five percent (5%) annually unless there are mitigating market conditions. Vendor must submit CPI justification or other supporting documentation along with all requests for pricing increases. Vendor may reduce pricing at any time during the contract term.

I see this question has been asked already but need further clarification. Related to future price increases, since the initial term of this ITB is for 3 years, then it is expected that the prices bid in the ITB are to be firm for those 3 years, with no allowance for a price increase request based on published manufacturer price increases or CPI growth?

Under Timeframe, you indidate orders must be received within Ten (10) business days from the guaranteed date of delivery/pick up availablity provided on the quote. Are you stating that all deliveries must be in 10 business days form date of order OR from the date that we state the product will be available? Is there any exception to the 1% penalty due to manufacturer product back order?

All orders must be received ten (10) business days of the guaranteed date of delivery/pick up provided on each order. Exceptions to the late delivery penalty will be considered so long as documentation of manufacturer's product back order is provided within the ten (10) business days.
